1. Acceptance of Terms

By accessing and using Fix My Excel File ("the Service"), operated by FME Solutions LLC ("the Company"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily use the Service for personal, non-commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials or software
• Use the materials for any commercial purpose or public display
• Attempt to decompile or reverse engineer any software contained on the Service
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or mirror the materials on any other server

3. File Upload and Processing

When you upload files to our Service:

• You retain all ownership rights to your files and data
• Files are processed using AI and automated systems
• Uploaded files may be temporarily stored for processing purposes
• We do not guarantee the recovery or repair of all file types or corruption issues
• You are responsible for maintaining backup copies of your original files

4. Prohibited Content and Regulatory Compliance

You expressly agree NOT to upload files containing personally identifiable information (PII) or sensitive data, including:

• Personal Identifiers: Social Security numbers, passport numbers, driver's license numbers, national ID numbers, tax IDs
• Financial Information: Credit card numbers, bank account numbers, payment information, or other financial credentials (PCI data)
• Health Information: Medical records, diagnoses, prescriptions, or other Protected Health Information (PHI) covered under HIPAA or similar healthcare privacy regulations
• Authentication Credentials: Passwords, access codes, security questions/answers, API keys, or authentication tokens
• Personal Data: Data subject to GDPR, CCPA, or other data protection regulations unless you have proper authorization
• Confidential Business Information: Trade secrets, proprietary information, or confidential data belonging to you or third parties
• Government Information: Classified, restricted, or controlled information under government regulations
• Minors' Information: Personal information about individuals under 18 years of age

Before uploading any file, you must remove or redact all sensitive information listed above. This Service is designed for file structure repair only and is not a secure platform for processing sensitive personal data.

You are solely responsible for ensuring that any files you upload comply with all applicable laws, regulations, and industry standards in your country and jurisdiction. This includes, but is not limited to, data protection laws, privacy regulations, export control laws, and intellectual property rights. By using this Service, you represent and warrant that your use complies with all such requirements.

5. Service Acceptance and Use

By uploading files to the Service, you are agreeing to use the Service under these Terms. We reserve the right to refuse service, terminate accounts, or remove uploaded content at our sole discretion without prior notice. The Basic Service is provided free of charge and is supported by advertisements. We may modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

7. Limitations of Liability

In no event shall FME Solutions LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service, even if we have been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

8. No Guarantee of Results

While we strive to repair corrupted Excel files effectively, we do not guarantee that all files can be successfully repaired or that all data will be recovered. The effectiveness of our repair service depends on the nature and extent of the file corruption. By using the Service, you acknowledge and accept this limitation.

9. Acceptable Use Policy

You agree not to use the Service to:

• Upload malicious files, viruses, or harmful code
• Violate any applicable local, state, national, or international law
• Infringe upon or violate the intellectual property rights of others
• Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• Submit false or misleading information
• Attempt to gain unauthorized access to the Service or related systems

10. User Representations and Warranties

By using the Service, you represent and warrant that:

• Any information provided by you is true, accurate, and complete
• You are the owner of, or are otherwise lawfully authorized to upload, any files you submit to the Service
• You will not use the Service for any illegal or unauthorized purpose
• You will not transmit any worms, viruses, or any code of a destructive nature
• You have read and understood the prohibited content restrictions in Section 4 and will comply with them
• You understand that we are not liable for any loss, damage, or delay resulting from incorrect or incomplete information you provide

11. Service Modifications

Fix My Excel File reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice at any time. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

12. Third-Party Services

12.1 Google Analytics

Our Service uses Google Analytics, a web analytics service provided by Google LLC, to help us understand how visitors use our Service. • Complete reCAPTCHA verification challenges when required before submitting files

Our Service contains advertisements provided by Propeller Ads and may contain links to third-party websites or services that are not owned or controlled by FME Solutions LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites, services, or advertisers.

Propeller Ads and other third-party advertising networks may display ads on our Service and may use their own cookies or tracking technologies. These third-party services are governed by their own privacy policies and terms of service. 12.4 Your Acknowledgment

You acknowledge and agree that FME Solutions LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third-party content, goods, or services available on or through any such websites or services.

13. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of FME Solutions LLC and are protected by international copyright, trademark, and other intellectual property laws.

14. Indemnification

You agree to indemnify, defend, and hold harmless FME Solutions LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which FME Solutions LLC operates, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in that jurisdiction.

16. Assignment

You may not assign any of your rights or delegate any of your obligations under these Terms without our prior written consent. Any purported assignment or delegation in violation of this section is null and void. No assignment or delegation relieves you of any of your obligations under these Terms.

17. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of FME Solutions LLC.

18. Force Majeure

We will not be liable or responsible for any failure or delay in performance of the Service when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities, terrorist threats or acts, riot or other civil unrest, national emergency, epidemic, pandemic, lockouts, strikes or other labor disputes, or restraints or delays affecting carriers, inability or delay in obtaining supplies of adequate or suitable materials, telecommunications breakdown, or power outage.

19. No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person or entity other than you and FME Solutions LLC.

20. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically for any updates.

21. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede any prior agreements.

22. Entire Agreement

These Terms constitute the entire agreement between you and FME Solutions LLC concerning the Service and supersede all prior or contemporaneous understandings and agreements, whether written or oral, with respect to the Service.
